Division of powersNine Lรคnder hold their own constitutions, parliaments and governments, but the federation retains far more legislative power than in Germany or Switzerland; much Lรคnder activity is administering federal law (mittelbare Bundesverwaltung). Three separate high courts sit at the apex, for constitutional, administrative and ordinary matters respectively.Unitary, with six districts and elected town and village councils. Maya communal land rights in Toledo are recognised through the courts rather than by statute, and implementation is supervised by the CCJ.Formally unitary over the West Bank and Gaza Strip. In practice the West Bank is divided into Areas A, B and C under the Oslo arrangements with differing Palestinian and Israeli competences, Area C remaining under Israeli civil and security administration, and Gaza has been separately administered since 2007. How law is madeBills originate with the government, members of the Nationalrat, the Bundesrat or a popular initiative, and pass three readings in the Nationalrat. The Bundesrat may object but can normally be overridden. The Federal President authenticates the law, the Chancellor countersigns, and it is published in the Bundesgesetzblatt.A bill passes three readings in the House of Representatives, then the Senate, and receives the Governor-General's assent. Money bills originate in the House. Constitutional amendments need a two-thirds majority of all House members, and certain entrenched provisions require three-quarters.The Basic Law contemplates bills passing the Legislative Council in three readings and being promulgated by the President. Since 2007, with the Council not sitting, legislation has been issued as presidential decree-law under Article 43, published in the Official Gazette al-Waqa'i al-Filastiniyya. Because Article 43 requires later presentation to the Council, the standing of the accumulated body of decree-laws is itself a live constitutional question.
Legal professionA Rechtsanwalt qualifies through a law degree, five years of practical training including at least three in a law firm and some months at court, and the bar examination. Admission is via the regional bar chambers under the umbrella of the ร–sterreichischer Rechtsanwaltskammertag. Notaries are a separate profession with appointments limited in number.A fused profession of attorneys-at-law admitted by the High Court under the Legal Profession Act, with the Bar Association of Belize exercising disciplinary functions. Commonwealth qualifications are recognised on application, which keeps a small bar workable.Lawyers are admitted by the Palestinian Bar Association after a law degree and a two-year traineeship, with compulsory membership. Practice is complicated by movement restrictions and by the divergence between West Bank and Gaza law, so practitioners tend to specialise territorially. Sharia court advocacy is separately licensed. Legal aid is provided mainly through the Bar's committees and by non-governmental clinics rather than a state defender service.
