Division of powersNine Lรคnder hold their own constitutions, parliaments and governments, but the federation retains far more legislative power than in Germany or Switzerland; much Lรคnder activity is administering federal law (mittelbare Bundesverwaltung). Three separate high courts sit at the apex, for constitutional, administrative and ordinary matters respectively.Unitary with constitutionally entrenched local government: 20 dzongkhags, each with an elected Dzongkhag Tshogdu, plus gewog and thromde councils. Article 22 requires devolution of power to elected local governments, and local bodies have defined planning and revenue functions.Under the suspended constitution, a semi-presidential system with a President, Prime Minister and National Assembly. Currently executive and legislative authority is concentrated in the CNSP and an appointed government.
How law is madeBills originate with the government, members of the Nationalrat, the Bundesrat or a popular initiative, and pass three readings in the Nationalrat. The Bundesrat may object but can normally be overridden. The Federal President authenticates the law, the Chancellor countersigns, and it is published in the Bundesgesetzblatt.Bills pass both houses; disagreement goes to a joint sitting. The King grants assent, and if he withholds it the bill returns to a joint sitting where a two-thirds majority carries it. Money bills originate in the National Assembly. Constitutional amendment requires a three-quarters majority of a joint sitting and, if the King so directs, a national referendum.Legislation is currently made by order of the governing authority and published in the Journal Officiel. The suspended constitution provided for ordinary parliamentary passage and presidential promulgation.
Legal professionA Rechtsanwalt qualifies through a law degree, five years of practical training including at least three in a law firm and some months at court, and the bar examination. Admission is via the regional bar chambers under the umbrella of the ร–sterreichischer Rechtsanwaltskammertag. Notaries are a separate profession with appointments limited in number.Regulated by the Bhutan National Legal Institute and the Jabmi Tshogdey (Bar Council) under the Jabmi Act. Practitioners, called jabmis, require a law degree โ€” historically obtained in India โ€” and a licence; the Jigme Singye Wangchuck School of Law in Thimphu graduated its first cohort in 2022, so domestic legal education is very new. The profession is small, numbering a few hundred licensed practitioners.Avocats admitted through the Barreau du Niger after a law degree and traineeship; notaires and huissiers are separate offices.
