Division of powersNine Lรคnder hold their own constitutions, parliaments and governments, but the federation retains far more legislative power than in Germany or Switzerland; much Lรคnder activity is administering federal law (mittelbare Bundesverwaltung). Three separate high courts sit at the apex, for constitutional, administrative and ordinary matters respectively.Unitary. Districts and sub-districts administer central policy, and the House of Chiefs (Ntlo ya Dikgosi) is an advisory chamber that must be consulted on bills affecting customary law, tribal organisation and tribal property.Unitary but substantially regionalised since 2015, with twelve regions holding directly elected councils and their own budgets under the advanced regionalisation programme. Regions have executive competences in development planning and transport; they do not legislate.
How law is madeBills originate with the government, members of the Nationalrat, the Bundesrat or a popular initiative, and pass three readings in the Nationalrat. The Bundesrat may object but can normally be overridden. The Federal President authenticates the law, the Chancellor countersigns, and it is published in the Bundesgesetzblatt.Bills are introduced in the National Assembly, take three readings with committee scrutiny between the second and third, and go to the President for assent. Bills affecting customary law, tribal property or the organisation of the tribes must first be referred to the Ntlo ya Dikgosi for its opinion, though that opinion does not bind the Assembly.Bills may be introduced by the head of government or by members of either chamber. They pass through committee and plenary in both houses, with the House of Representatives having the final word where the chambers disagree. Organic laws must be referred to the Constitutional Court before promulgation. The King promulgates statutes by dahir within thirty days, and may ask parliament to reconsider a bill or submit it to referendum.
Legal professionA Rechtsanwalt qualifies through a law degree, five years of practical training including at least three in a law firm and some months at court, and the bar examination. Admission is via the regional bar chambers under the umbrella of the ร–sterreichischer Rechtsanwaltskammertag. Notaries are a separate profession with appointments limited in number.A fused profession of attorneys admitted by the High Court after a recognised law degree and articles of pupillage; there is no split between advocates and attorneys, and the Law Society of Botswana regulates practice.Avocats are admitted to one of the regional bars and organised nationally through the Association des Barreaux du Maroc; practice before the Court of Cassation requires additional seniority. Notaries and adouls coexist โ€” the notaire handles conveyancing and company documents in the French tradition, while the adoul draws up marriage and inheritance instruments under Islamic law. Judges are career appointments trained at the Institut Supรฉrieur de la Magistrature.
