Division of powersNine Lรคnder hold their own constitutions, parliaments and governments, but the federation retains far more legislative power than in Germany or Switzerland; much Lรคnder activity is administering federal law (mittelbare Bundesverwaltung). Three separate high courts sit at the apex, for constitutional, administrative and ordinary matters respectively.A decentralised unitary state rather than a federation: twelve provinces and the municipalities hold delegated autonomy, not sovereign competence. How law is madeBills originate with the government, members of the Nationalrat, the Bundesrat or a popular initiative, and pass three readings in the Nationalrat. The Bundesrat may object but can normally be overridden. The Federal President authenticates the law, the Chancellor countersigns, and it is published in the Bundesgesetzblatt.A bill is submitted to the Advisory Division of the Council of State for an opinion, then to the Tweede Kamer, which may amend it, and then to the Eerste Kamer, which may only accept or reject. After adoption it is signed by the King and the responsible minister and published in the Staatsblad.Bills are read three times in the National Assembly, considered in committee, and assented to by the President, who may withhold assent and return a bill once. Money bills are the executive's initiative. Ordinary amendment of the Constitution needs two-thirds of all elected members; deeply entrenched articles additionally require approval at a referendum.
Legal professionA Rechtsanwalt qualifies through a law degree, five years of practical training including at least three in a law firm and some months at court, and the bar examination. Admission is via the regional bar chambers under the umbrella of the ร–sterreichischer Rechtsanwaltskammertag. Notaries are a separate profession with appointments limited in number.Advocaten are admitted to the bar (Nederlandse orde van advocaten) after a law degree and a three-year traineeship with the professional course. Representation by an advocaat is compulsory before most courts but not before the kantonrechter. Notaries and bailiffs (deurwaarders) are separate regulated professions.A fused profession: an attorney-at-law both advises and appears. Qualification is normally an LLB from the University of Guyana followed by the Legal Education Certificate from a Council of Legal Education school, then admission by the High Court. The Guyana Bar Association represents practitioners while discipline rests with the courts.
