Legal information, not legal advice. Every jurisdiction page carries its verification status and sources.

Comparison

Read two legal systems against each other

Because every portal follows the same fifteen-section outline, the comparison is genuinely like-for-like rather than a collage of whatever each government happens to publish.

Division of powersUnitary with four regions and 55 tinkhundla constituencies that combine electoral and administrative functions. Chiefs administer Swazi Nation Land under the King as trustee.Federal. Powers not expressly granted to the union are reserved to the 32 states (Article 124). States run their own civil, family and criminal-enforcement codes, but criminal procedure, labour and commercial law were federalised to produce single national codes.A unitary state of about two square kilometres with a single commune. Legislative power is exercised jointly by the Prince and the National Council; executive power belongs to the Prince, exercised through the Minister of State and the Government Council; judicial power is delegated by the Prince to the courts, with the Tribunal Suprรชme acting as both constitutional and supreme administrative court.Unitary with 14 administrative regions and elected regional councils, which also constitute the National Council, the upper chamber. Traditional authorities exercise recognised functions over communal land and customary law.
How law is madeBills pass the House of Assembly and Senate and require royal assent, which the King may withhold. The King may also legislate by decree in defined circumstances, and bills touching Swazi law and custom are referred to traditional structures. Constitutional amendment requires a two-thirds majority of both chambers sitting jointly, and for entrenched provisions a referendum.Bills may be introduced by the President, either chamber, state legislatures or by citizens with 0.13% of the electoral roll. Both chambers must pass an identical text; the President may veto, and Congress overrides with two-thirds of each chamber. Constitutional amendments need two-thirds of Congress plus a majority of state legislatures (Article 135).A bill may be initiated by the Prince or proposed by the National Council. Government bills are laid before the Council, examined in committee and voted; adoption requires the agreement of both the Prince and the Council. The Prince then promulgates the law by sovereign ordinance and it is published in the Journal de Monaco.Bills pass the National Assembly through three readings, then go to the National Council for review. The Council may confirm, propose amendments, or object; the Assembly can override an objection by a two-thirds majority. The President then assents, and constitutional amendments require two-thirds of both chambers and may never diminish the rights chapter.
Legal professionA fused profession of attorneys admitted by the High Court after a law degree and articles, regulated by the Law Society of Eswatini; advocates may be admitted separately for higher-court work.A law degree plus a cรฉdula profesional from the Education Ministry licenses practice; there is no compulsory bar examination or single mandatory bar, which distinguishes Mexico from most of the region. Notaries public are a separate, strictly limited state-appointed profession with exclusive competence over real estate and company deeds.A small bar of avocats-dรฉfenseurs, avocats and avocats stagiaires, organised as the Ordre des Avocats, with admission requiring Monegasque nationality preference, a law degree and a traineeship. French avocats may appear in specified circumstances. Notaries are appointed by sovereign ordinance and are few in number.A fused profession under the Legal Practitioners Act: a single class of legal practitioner is admitted after a law degree and the Justice Training Centre's postgraduate course, and the Law Society of Namibia regulates practice.

A comparison table flattens nuance by design. Where a difference matters to a decision you are making, open both portals and read the section in full โ€” the constitutional detail behind a one-line summary is often the part that governs the outcome.
