Division of powersUnitary. Seventeen regions (oblasts) and three cities of republican significance — Astana, Almaty and Shymkent — each headed by an akim appointed by the President. Local representative assemblies (maslikhats) have limited competence. Overlaid on this is the Astana International Financial Centre, a territorially delimited zone with its own court, arbitration centre, regulator and body of law that operates outside the national legal order.Federal, with four provinces — Punjab, Sindh, Khyber Pakhtunkhwa and Balochistan — plus Islamabad Capital Territory, and Azad Jammu and Kashmir and Gilgit-Baltistan under distinct constitutional arrangements. The 18th Amendment abolished the Concurrent Legislative List, leaving residual power with the provinces and giving them primary responsibility for education, health, labour and local government. The Council of Common Interests mediates federal-provincial disputes over resources.
How law is madeBills are introduced in the Mazhilis by deputies or the Government, and must pass the Mazhilis before going to the Senate. If the Senate rejects a bill it returns to the Mazhilis, and a joint commission may be convened. The President may veto, and an override requires two-thirds of each chamber. The President may also declare a bill urgent, requiring consideration within a month, and may issue decrees with the force of law where Parliament has delegated that power. Laws enter force ten days after official publication unless otherwise stated.Money bills originate in the National Assembly only. Other bills may start in either house and must pass both; disagreement is resolved in a joint sitting. The President may return a bill once, after which a joint sitting can override. Constitutional amendments need a two-thirds majority in both houses. Provincial assemblies legislate on all matters not on the Federal Legislative List.
Legal professionAdvocates are licensed under the Law on Advocacy and Legal Assistance 2018, which introduced mandatory membership of regional bar collegia coordinated by the Republican Bar Association, and separated advocates from other legal-services providers who must register separately. Entry requires a law degree, an internship and a qualifying examination. Notaries are a distinct licensed profession whose involvement is compulsory for many real-estate and corporate transactions. Practitioners in the AIFC Court are registered separately and may be foreign-qualified.A single fused profession of advocates, enrolled with a provincial bar council after a law degree and the licensing examination, with separate rights of audience acquired by seniority: enrolment allows appearance in subordinate courts, then the High Court after two years, then the Supreme Court after ten years of High Court practice. The Pakistan Bar Council regulates nationally. Bar associations are politically influential and were central to the 2007-2009 lawyers' movement that secured the restoration of the deposed Chief Justice.
