Division of powersUnitary with statutory island councils. The Local Government Act gives each inhabited island a council with bylaw-making powers, and on most islands the traditional maneaba (meeting house assembly) remains the real forum for community decisions. Banaba (Ocean Island) has a distinct status reflecting the displacement of the Banaban community to Rabi in Fiji, with reserved representation in the Maneaba.Federal. Powers not expressly granted to the union are reserved to the 32 states (Article 124). States run their own civil, family and criminal-enforcement codes, but criminal procedure, labour and commercial law were federalised to produce single national codes.
How law is madeBills receive three readings in the single chamber and are assented to by the Beretitenti. Constitutional amendments require a two-thirds majority of all members, and amendments affecting Banaban land rights or the Banaban representative additionally require the support of the Rabi Council of Leaders — a rare example of a minority community holding a constitutional veto.Bills may be introduced by the President, either chamber, state legislatures or by citizens with 0.13% of the electoral roll. Both chambers must pass an identical text; the President may veto, and Congress overrides with two-thirds of each chamber. Constitutional amendments need two-thirds of Congress plus a majority of state legislatures (Article 135).
Legal professionA small fused profession admitted by the High Court under the Legal Practitioners Ordinance. Many practitioners are in government service, and the People's Lawyer's office carries most private client work. Because the Court of Appeal is non-resident, appellate hearings are grouped into sittings when judges travel to Tarawa.A law degree plus a cédula profesional from the Education Ministry licenses practice; there is no compulsory bar examination or single mandatory bar, which distinguishes Mexico from most of the region. Notaries public are a separate, strictly limited state-appointed profession with exclusive competence over real estate and company deeds.
