How law is madeThere is no single functioning legislative process. The House of Representatives passes laws that the High Council of State contests, and the rival administrations issue decrees within their areas of control. Whether a given instrument is law therefore depends on which authority is recognised, which is exactly why this profile is marked as requiring research rather than described as settled.A bill passes three readings in the House of Representatives, then the Senate, and receives the Governor-General's assent. Money bills originate in the House. Constitutional amendments need a two-thirds majority of all House members, and certain entrenched provisions require three-quarters.Bills pass the House of Representatives and the Council of the Republic and are signed by the President, who may return them. Separately, the President may issue decrees and edicts with the force of law, including on matters otherwise reserved to statute.
Legal professionAdvocates are admitted through the Libyan Bar Association, and the profession has continued to function, including in human-rights litigation, despite serious risks to practitioners. Judicial appointments run through the Supreme Judicial Council. Commonwealth qualifications are recognised on application, which keeps a small bar workable.Advocacy is organised through territorial bar collegiums under close Ministry of Justice supervision; 2021 amendments abolished independent practice and required membership of a legal consultancy office.
