Comparison

Read two legal systems against each other

Because every portal follows the same fifteen-section outline, the comparison is genuinely like-for-like rather than a collage of whatever each government happens to publish.

Division of powersA unitary state of eleven communes, which retain a constitutional right of secession. Power is shared between the Prince, the Landtag and the electorate: 1,000 citizens can demand a referendum on a law and 1,500 can initiate a constitutional amendment. EEA membership adds a supranational layer supervised by the EFTA Surveillance Authority and the EFTA Court.Federal in form, with member states including Puntland, Jubaland, South West, Hirshabelle and Galmudug. The division of powers was left to be settled by later agreement and remains contested, particularly over revenue and security. Somaliland, in the northwest, does not participate and administers its own institutions.Unitary. The Legislative Assembly legislates for the whole kingdom, and the island divisions of Tongatapu, Vava'u, Ha'apai, 'Eua and the Niuas are administrative districts headed by governors. Below that, town and district officers are elected under the Fakafekau'aki and District and Town Officers Act.
How law is madeA bill is debated and adopted by the Landtag, then requires the sanction of the Reigning Prince, whose refusal is absolute and not overridable. Statutes may be subjected to a referendum on the demand of 1,000 citizens or of the Landtag itself, and are published in the Landesgesetzblatt.Bills are introduced by the government or members and passed by the House of the People, with the Upper House participating on matters affecting member states, before presidential assent. Because Article 2 subjects all legislation to consistency with Sharia and no court exists to adjudicate that limit, and because member-state legislation operates in parallel, the effective legislative picture cannot be described as unified.Bills pass three readings in the Legislative Assembly and require the King's assent, which is a real rather than purely formal step. Ordinary bills need a simple majority. Amendments to the Constitution require a majority in the Assembly at three separate readings and the consent of the King and Privy Council, and clause 79 forbids any amendment affecting the law of liberty, the succession to the throne or the titles and hereditary estates of the nobles.
Legal professionRechtsanwรคlte are admitted by the Liechtenstein Bar Association after a law degree, a supervised traineeship and the bar examination; qualifications from Austria and Switzerland are widely recognised. Trustees (Treuhรคnder) are a distinct and significant regulated profession given the importance of foundations and asset structures.Advocates practise through the Somali Bar Association and regional bar associations, with legal education rebuilt through universities in Mogadishu, Hargeisa and elsewhere since the 1990s. Many practitioners work across the formal courts and customary forums, since a client's remedy often lies in the latter. Verified current figures on admission and numbers are not available, which is reflected in this entry's status.Law practitioners are admitted by the Chief Justice and licensed under the Law Practitioners Act, with the Tonga Law Society as the professional body. Most qualify overseas or at the University of the South Pacific. A practitioner working on land must know the Land Act's allotment system rather than general property law, because the constitutional bar on selling land means conveyancing in the ordinary sense does not exist.

A comparison table flattens nuance by design. Where a difference matters to a decision you are making, open both portals and read the section in full โ€” the constitutional detail behind a one-line summary is often the part that governs the outcome.
