Division of powersA unitary state of about two square kilometres with a single commune. How law is madeA bill may be initiated by the Prince or proposed by the National Council. Government bills are laid before the Council, examined in committee and voted; adoption requires the agreement of both the Prince and the Council. The Prince then promulgates the law by sovereign ordinance and it is published in the Journal de Monaco.Bills go to the Assembly from members, the President, the Court, citizens or autonomous governments, and need two debates. The President may fully or partially object; a full objection can only be overcome after a year or by a two-thirds vote. Urgent economic bills become law by decree if the Assembly fails to act in thirty days. Amendment routes differ by depth, from Assembly vote to constituent assembly.Bills originate with the government, Bundestag or Bundesrat, pass three readings in the Bundestag, then require Bundesrat consent or non-objection; a mediation committee resolves deadlock.
Legal professionA small bar of avocats-dรฉfenseurs, avocats and avocats stagiaires, organised as the Ordre des Avocats, with admission requiring Monegasque nationality preference, a law degree and a traineeship. French avocats may appear in specified circumstances. Notaries are appointed by sovereign ordinance and are few in number.A law degree plus registration in the Forense registry of the Consejo de la Judicatura, and usually membership of a provincial colegio de abogados. The Judicature Council holds disciplinary power. Public defence is provided by the Defensorรญa Pรบblica, a separate autonomous body.Two state examinations plus a two-year Referendariat produce the unified jurist qualified as Rechtsanwalt, judge, prosecutor or notary.
