Division of powersA unitary state of about two square kilometres with a single commune. Legislative power is exercised jointly by the Prince and the National Council; executive power belongs to the Prince, exercised through the Minister of State and the Government Council; judicial power is delegated by the Prince to the courts, with the Tribunal Suprรชme acting as both constitutional and supreme administrative court.Unitary. Government bills are laid before the Council, examined in committee and voted; adoption requires the agreement of both the Prince and the Council. The Prince then promulgates the law by sovereign ordinance and it is published in the Journal de Monaco.Draft legislation is prepared by ministries and the Council of Ministers, may be referred to the Council of Oman for review, and takes effect on the Sultan's signature and publication in the Official Gazette. The Majlis al-Shura may propose legislation and question ministers, and its role was modestly strengthened after 2011, but it cannot enact or block a royal decree.Money bills originate in the National Assembly only. Other bills may start in either house and must pass both; disagreement is resolved in a joint sitting. The President may return a bill once, after which a joint sitting can override. Constitutional amendments need a two-thirds majority in both houses. Provincial assemblies legislate on all matters not on the Federal Legislative List.
Legal professionA small bar of avocats-dรฉfenseurs, avocats and avocats stagiaires, organised as the Ordre des Avocats, with admission requiring Monegasque nationality preference, a law degree and a traineeship. French avocats may appear in specified circumstances. Notaries are appointed by sovereign ordinance and are few in number.Advocacy is regulated by the Ministry of Justice and Legal Affairs; Omani nationality is required for rights of audience, and foreign lawyers practise as consultants within licensed firms. Pleadings are in Arabic. Judges are appointed by royal decree on the recommendation of the Supreme Judicial Council. Notarisation is required for real property dispositions, and land registration is administered by the Ministry of Housing and Urban Planning.A single fused profession of advocates, enrolled with a provincial bar council after a law degree and the licensing examination, with separate rights of audience acquired by seniority: enrolment allows appearance in subordinate courts, then the High Court after two years, then the Supreme Court after ten years of High Court practice. The Pakistan Bar Council regulates nationally. Bar associations are politically influential and were central to the 2007-2009 lawyers' movement that secured the restoration of the deposed Chief Justice.
