Division of powersNominally a union of seven regions, seven states, one union territory and six self-administered zones and divisions, each with its own legislature under the 2008 Constitution. In practice the region and state legislatures are suspended or subordinated to the military administration, and chief ministers are appointed centrally.Unitary. How law is madeUnder the 2008 Constitution, bills passed both chambers and went to the President, with disagreements resolved in joint sitting. Since February 2021 legislation is made by the State Administration Council as law or order, published in the Gazette without legislative passage, and a series of such instruments has amended the Penal Code, the electronic communications law and the criminal procedure code.Bills are introduced by members of the State Great Khural, the President or the Cabinet, considered in standing committee and then in plenary. The President may veto a bill in whole or in part, and the veto is overridden by a two-thirds majority. Laws take effect ten days after publication in the State Information Bulletin unless the statute provides otherwise. The Law on Legislation requires regulatory impact assessment and public consultation for draft laws.Bills originate with the government, members of the Nationalrat, the Bundesrat or a popular initiative, and pass three readings in the Nationalrat. The Bundesrat may object but can normally be overridden. The Federal President authenticates the law, the Chancellor countersigns, and it is published in the Bundesgesetzblatt.
Legal professionAdvocates and higher-grade pleaders are admitted under the Legal Practitioners Act 1879 and the Bar Council Act 1929, an inherited colonial framework, with the Supreme Court controlling the roll. Independent bar associations formed after 2011 but the Bar Council has long been closely supervised, and lawyers acting in political cases have themselves faced prosecution and disbarment since 2021. Legal aid exists under the Legal Aid Law 2016 but is thinly resourced.Advocates are licensed under the Law on the Legal Status of Lawyers 2012, which separated the profession into advocates, prosecutors and notaries and created the Mongolian Bar Association as a self-governing body with mandatory membership. Entry requires a law degree, a qualifying examination and a period of supervised practice. Notaries hold a distinct licence and their involvement is mandatory for many property and corporate transactions, a survival of the Soviet-era formality requirements.A Rechtsanwalt qualifies through a law degree, five years of practical training including at least three in a law firm and some months at court, and the bar examination. Admission is via the regional bar chambers under the umbrella of the ร–sterreichischer Rechtsanwaltskammertag. Notaries are a separate profession with appointments limited in number.
