Division of powersUnitary. Parliament legislates for the whole country and there are no states or provinces. Regional and territorial authorities exist only under the Local Government Act 2002 and exercise delegated statutory powers. Tokelau is a non-self-governing territory, while the Cook Islands and Niue are self-governing in free association with New Zealand and have their own legal systems.Formally unitary over the West Bank and Gaza Strip. In practice the West Bank is divided into Areas A, B and C under the Oslo arrangements with differing Palestinian and Israeli competences, Area C remaining under Israeli civil and security administration, and Gaza has been separately administered since 2007. East Jerusalem is administered by Israel. The atlas records this fragmentation rather than describing a single uniform jurisdiction.
How law is madeA bill has a first reading, select committee scrutiny (usually with public submissions), second reading, committee of the whole House, and third reading, followed by Royal assent. There is no upper house, so the select committee stage carries the weight that a second chamber would elsewhere. The Attorney-General must report to the House under section 7 of the Bill of Rights Act on any bill that appears inconsistent with protected rights, but the House may pass it anyway. Reserved provisions of the Electoral Act 1993 require either 75% of all members or a majority at referendum.The Basic Law contemplates bills passing the Legislative Council in three readings and being promulgated by the President. Since 2007, with the Council not sitting, legislation has been issued as presidential decree-law under Article 43, published in the Official Gazette al-Waqa'i al-Filastiniyya. Because Article 43 requires later presentation to the Council, the standing of the accumulated body of decree-laws is itself a live constitutional question.
Legal professionA fused profession under the Lawyers and Conveyancers Act 2006: a lawyer is admitted as a barrister and solicitor of the High Court, and may then practise as a barrister sole or in a firm. Admission requires an approved law degree, the Professional Legal Studies Course and a certificate of character. The New Zealand Law Society | Te Kฤhui Ture o Aotearoa regulates the profession, and King's Counsel are appointed from senior practitioners.Lawyers are admitted by the Palestinian Bar Association after a law degree and a two-year traineeship, with compulsory membership. Practice is complicated by movement restrictions and by the divergence between West Bank and Gaza law, so practitioners tend to specialise territorially. Sharia court advocacy is separately licensed. Legal aid is provided mainly through the Bar's committees and by non-governmental clinics rather than a state defender service.
