Division of powersUnitary with seventeen departments and the capital district, each with an elected governor and departmental board holding administrative and limited fiscal competence. Legislative power is national.Semi-presidential: a directly elected President, a Prime Minister from the parliamentary majority, and a bicameral Parliament. The 2006 constitution split the former Supreme Court into three separate apex courts.Unitary, organised on the principle of a single system of state power. The President promulgates within the constitutional period, and the Constitutional Court may be seised beforehand.Legislative initiative lies with deputies, the Council of State, the Council of Ministers, the courts, the Prosecutor General, mass organisations and 10,000 citizens by popular initiative. The Assembly meets in short ordinary sessions, so much law is made by decree-law of the Council of State and subsequently ratified. Constitutional amendment requires two-thirds of the Assembly, and a referendum for provisions on the political system or rights.Bills are introduced by the government or members and passed by the House of the People, with the Upper House participating on matters affecting member states, before presidential assent. Because Article 2 subjects all legislation to consistency with Sharia and no court exists to adjudicate that limit, and because member-state legislation operates in parallel, the effective legislative picture cannot be described as unified.
Legal professionA law degree and registration of the title with the Supreme Court, which maintains the roll and exercises discipline. Bar membership is voluntary. Because both Spanish and Guaranรญ are official, courts must provide interpretation, and practitioners outside Asunciรณn are commonly bilingual.Avocats admitted to provincial bars under the national Ordre des avocats after a law degree and traineeship; dรฉfenseurs judiciaires assist in lower courts.Practising litigators generally work through the Organizaciรณn Nacional de Bufetes Colectivos, a self-financing national body of collective law offices; independent private practice is not a recognised route. Membership of the Uniรณn Nacional de Juristas de Cuba is the professional association. Notarial functions are performed by state notaries.Advocates practise through the Somali Bar Association and regional bar associations, with legal education rebuilt through universities in Mogadishu, Hargeisa and elsewhere since the 1990s. Many practitioners work across the formal courts and customary forums, since a client's remedy often lies in the latter.
