Division of powersUnitary with seventeen departments and the capital district, each with an elected governor and departmental board holding administrative and limited fiscal competence. Legislative power is national.A unitary state of about two square kilometres with a single commune. Constitutional amendment requires a two-thirds vote of each chamber and ratification by referendum; wholesale reform requires a constituent assembly.A bill may be initiated by the Prince or proposed by the National Council. Government bills are laid before the Council, examined in committee and voted; adoption requires the agreement of both the Prince and the Council. The Prince then promulgates the law by sovereign ordinance and it is published in the Journal de Monaco.A draft goes through a formal consultation procedure (Vernehmlassung) with cantons and interest groups, then must be adopted in identical terms by both chambers, with a conciliation procedure to resolve differences. It then faces a hundred-day window in which 50,000 citizens can demand an optional referendum; only after that period, or a favourable vote, does it enter into force.Bills pass the National Assembly through three readings, then go to the National Council for review. The Council may confirm, propose amendments, or object; the Assembly can override an objection by a two-thirds majority. The President then assents, and constitutional amendments require two-thirds of both chambers and may never diminish the rights chapter.
Legal professionA law degree and registration of the title with the Supreme Court, which maintains the roll and exercises discipline. Bar membership is voluntary. Because both Spanish and Guaranรญ are official, courts must provide interpretation, and practitioners outside Asunciรณn are commonly bilingual.A small bar of avocats-dรฉfenseurs, avocats and avocats stagiaires, organised as the Ordre des Avocats, with admission requiring Monegasque nationality preference, a law degree and a traineeship. French avocats may appear in specified circumstances. Notaries are appointed by sovereign ordinance and are few in number.The Rechtsanwalt / avocat / avvocato qualification is cantonal: a law degree, a supervised traineeship and a cantonal bar examination, after which registration in a cantonal register permits practice throughout Switzerland. The Swiss Bar Association federates the cantonal bars. Notaries are separately regulated, and in some cantons the office is a public monopoly.A fused profession under the Legal Practitioners Act: a single class of legal practitioner is admitted after a law degree and the Justice Training Centre's postgraduate course, and the Law Society of Namibia regulates practice.
