Division of powersUnitary with statutory decentralisation. Nine provinces plus Honiara City have assemblies under the Provincial Government Act 1997 exercising powers delegated by Parliament, not entrenched by the Constitution. Proposals for a federal structure have been debated since the conflict but never enacted.Centralised. 34 provinces are administered by appointed governors reporting to the central administration, with authority concentrated in the Amir and the leadership based in Kandahar. How law is madeBills receive three readings in the single chamber, are usually referred to a Bills and Legislation Committee, and then receive the Governor-General's assent. Ordinary bills need a simple majority of those present. Constitutional amendments need two-thirds of all members, rising to three-quarters for entrenched provisions such as the Bill of Rights and the office of Governor-General.There is no legislature in session and no published bill procedure. Rules take effect through decrees and ministerial instructions attributed to the Amir or the cabinet, publicised by announcement rather than through a functioning official gazette process.
Legal professionA fused profession under the Legal Practitioners Act: practitioners are admitted by the High Court and hold a practising certificate. Most qualify through the University of the South Pacific in Vanuatu or Fiji and complete the Professional Diploma in Legal Practice. The Solomon Islands Bar Association is the professional body, while admission and discipline sit with the High Court and the Legal Practitioners Disciplinary Committee.The Afghanistan Independent Bar Association, established in 2008 and which had licensed several thousand advocates including many women, was taken over by the Ministry of Justice in November 2021 and its independent regulatory role ended. Licensing now runs through the ministry. Many practitioners have left the country or ceased practice, and women's ability to appear as advocates or to work as judges has been curtailed.
