Division of powersUnitary with decentralised administration. Six provinces — Malampa, Penama, Sanma, Shefa, Tafea and Torba — have councils under the Decentralisation Act with delegated functions. Custom land management is decentralised much further, to area-level Custom Land Tribunals and nakamal-based decision-making under the Custom Land Management Act 2013.Unitary. How law is madeBills are read three times in the single chamber and assented to by the President, who may refer a bill to the Supreme Court if he considers it inconsistent with the Constitution. Ordinary bills need a simple majority of members present, with a quorum of two-thirds. Constitutional amendments require a two-thirds majority of all members; if the amendment touches the status of Bislama, English or French, land, or the republican form of the state, it must also be approved at a national referendum.Bills originate with the President or in either chamber, though tax, budget and social-security bills are the President's exclusive initiative — an unusually strong executive agenda power. Both chambers must approve; a mixed committee resolves conflict. The President may veto, overridden by two-thirds. Constitutional amendment needs four-sevenths of sitting members, with two-thirds for certain entrenched chapters.Draft legislation is prepared by ministries and the Council of Ministers, may be referred to the Council of Oman for review, and takes effect on the Sultan's signature and publication in the Official Gazette. The Majlis al-Shura may propose legislation and question ministers, and its role was modestly strengthened after 2011, but it cannot enact or block a royal decree.
Legal professionA fused profession regulated by the Legal Practitioners Act: practitioners are admitted by the Chief Justice and licensed by the Law Council. The University of the South Pacific's law school is in Port Vila, so many Pacific lawyers train in Vanuatu. Practitioners may need to work in Bislama, English or French depending on the client and the court file, and the Public Solicitor is a constitutional office rather than a discretionary aid scheme.A five-year degree, a supervised practice period, and admission by the Supreme Court itself, which is unusual — the Court, not a bar, confers the title of abogado. Membership of the Colegio de Abogados has been voluntary since 1981, so the Court retains disciplinary jurisdiction over misconduct.Advocacy is regulated by the Ministry of Justice and Legal Affairs; Omani nationality is required for rights of audience, and foreign lawyers practise as consultants within licensed firms. Pleadings are in Arabic. Judges are appointed by royal decree on the recommendation of the Supreme Judicial Council. Notarisation is required for real property dispositions, and land registration is administered by the Ministry of Housing and Urban Planning.
