How law is madeBills are gazetted, then pass both the National Assembly and the Senate with committee scrutiny, and the Parliamentary Legal Committee reports on whether a bill or statutory instrument is consistent with the constitution โ€” a step with no direct equivalent in the region. The President assents; constitutional amendments require two-thirds of the membership of each chamber, and some provisions additionally require a referendum.Bills are introduced by ministers or members and passed by the House of Representatives. The President may return a law for reconsideration or refer it to the Supreme Court for a constitutionality ruling before promulgation; if the Court finds no conflict, promulgation follows. Laws enter into force on publication in the Official Gazette unless otherwise provided, and EU obligations are frequently implemented by harmonising statute and regulation.A bill is submitted to the Advisory Division of the Council of State for an opinion, then to the Tweede Kamer, which may amend it, and then to the Eerste Kamer, which may only accept or reject. After adoption it is signed by the King and the responsible minister and published in the Staatsblad.
Legal professionA fused profession of legal practitioners registered under the Legal Practitioners Act after a law degree and practical training, regulated by the Law Society of Zimbabwe; senior practitioners may be appointed Senior Counsel.A fused profession of advocates admitted under the Advocates Law after a law degree, the Legal Council examinations and a twelve-month pupillage, with compulsory membership of the Cyprus Bar Association. Many practitioners qualify in the United Kingdom or Greece, and English-language practice is standard in commercial work. Advocates hold a monopoly on court representation and on certifying company documents, and the profession is unusually large per head of population because of the international corporate and trusts business.Advocaten are admitted to the bar (Nederlandse orde van advocaten) after a law degree and a three-year traineeship with the professional course. Representation by an advocaat is compulsory before most courts but not before the kantonrechter. Notaries and bailiffs (deurwaarders) are separate regulated professions.
