How law is madeBills are gazetted, then pass both the National Assembly and the Senate with committee scrutiny, and the Parliamentary Legal Committee reports on whether a bill or statutory instrument is consistent with the constitution โ€” a step with no direct equivalent in the region. The President assents; constitutional amendments require two-thirds of the membership of each chamber, and some provisions additionally require a referendum.Bills are read three times in the National Assembly, considered in committee, and assented to by the President, who may withhold assent and return a bill once. Money bills are the executive's initiative. Ordinary amendment of the Constitution needs two-thirds of all elected members; deeply entrenched articles additionally require approval at a referendum.The Basic Law contemplates bills passing the Legislative Council in three readings and being promulgated by the President. Since 2007, with the Council not sitting, legislation has been issued as presidential decree-law under Article 43, published in the Official Gazette al-Waqa'i al-Filastiniyya. Because Article 43 requires later presentation to the Council, the standing of the accumulated body of decree-laws is itself a live constitutional question.
Legal professionA fused profession of legal practitioners registered under the Legal Practitioners Act after a law degree and practical training, regulated by the Law Society of Zimbabwe; senior practitioners may be appointed Senior Counsel.A fused profession: an attorney-at-law both advises and appears. Qualification is normally an LLB from the University of Guyana followed by the Legal Education Certificate from a Council of Legal Education school, then admission by the High Court. The Guyana Bar Association represents practitioners while discipline rests with the courts.Lawyers are admitted by the Palestinian Bar Association after a law degree and a two-year traineeship, with compulsory membership. Practice is complicated by movement restrictions and by the divergence between West Bank and Gaza law, so practitioners tend to specialise territorially. Sharia court advocacy is separately licensed. Legal aid is provided mainly through the Bar's committees and by non-governmental clinics rather than a state defender service.
