Because sessions are short and infrequent, a great deal of binding detail is issued as government decrees and ministerial instructions between sittings.Transitional texts have been adopted by the Conseil national de la transition or issued as ordinances; the 2025 constitution provides for ordinary legislative passage and promulgation.Bills are introduced in the National Assembly, take three readings with committee scrutiny between the second and third, and go to the President for assent. Bills affecting customary law, tribal property or the organisation of the tribes must first be referred to the Ntlo ya Dikgosi for its opinion, though that opinion does not bind the Assembly.
Legal professionThe Lao Bar Association, established under the Law on Lawyers, licenses practitioners after a law degree and a period of supervised practice; the profession remains very small relative to population. Village mediation units handle a large share of civil and family disputes before any court becomes involved, and are formally recognised as part of the justice system rather than an informal alternative to it. Foreign lawyers advise on commercial and investment matters but cannot appear in court.Avocats admitted through the Barreau de Guinรฉe after a law degree and traineeship; notaires and huissiers are separate offices.A fused profession of attorneys admitted by the High Court after a recognised law degree and articles of pupillage; there is no split between advocates and attorneys, and the Law Society of Botswana regulates practice.
