Suriname · Overview
The legal system of Suriname
The only Dutch-language jurisdiction in the Americas, and a civil-law system directly descended from the Netherlands codes: the Surinamese Civil Code still tracks the old Dutch Burgerlijk Wetboek, which the Netherlands itself replaced in 1992. Dutch remains the language of legislation and the courts. Suriname has no external appellate court, though it accepts the jurisdiction of the Inter-American Court of Human Rights, whose Saramaka and Moiwana judgments against it are leading authorities on tribal land rights.
Legal tradition
Suriname belongs to the civil law tradition.
How power is divided
Unitary, with ten districts headed by appointed district commissioners and elected district councils. Indigenous and Maroon communities in the interior are governed by traditional authorities whose land rights are not yet fully codified, despite repeated Inter-American Court rulings requiring it.
Where law comes from
- Constitution
- Supreme; enforced by the Constitutional Court since 2020.
- Ratified treaties
- Self-executing provisions take precedence over conflicting national law.
- Codes
- Burgerlijk Wetboek, Wetboek van Strafrecht, Wetboek van Burgerlijke Rechtsvordering — all Dutch-derived.
- Case law
- Not formally binding; Dutch doctrine and older Dutch case law remain persuasive.
The legal profession
Qualification is by a Surinamese law degree from the Anton de Kom University followed by admission as an advocaat by the Hof van Justitie and enrolment in the Surinaamse Orde van Advocaten. Practice is conducted in Dutch, so foreign parties should budget for sworn translation; notarissen hold exclusive competence over conveyancing and company deeds.
