The apex of the ordinary civil and criminal hierarchy, tracing to the Ottoman Divan-ı Ahkâm-ı Adliye. A separate Council of State (Danıştay) is the apex for administrative matters, so a challenge to state action runs through the administrative courts and not through this court. Turkish private law derives from the Swiss Civil Code and Code of Obligations adopted in 1926, and the Penal Code from the Italian model, later recodified in 2004.
