The hierarchy, top to bottom
- Final appellate — High Court (sitting as final appellate)
- Apex of the ordinary judiciary in Asmara.
- Appellate — Regional courts
- Appeals from sub-regional courts and first instance in more serious matters.
- First instance — Sub-regional and community courts
- Community courts handle small civil and customary matters at village level.
- Special — Special Court
- Established outside the ordinary system in 1996; sits without defence counsel or appeal, and its use is a central concern in reporting on the country.
