Kyrgyzstan · Overview
The legal system of Kyrgyzstan
A post-Soviet civil-law system whose constitutional form has changed more often than any of its neighbours': a parliamentary republic was created in 2010 after the second revolution, and dismantled by referendum in 2021 in favour of a strongly presidential model. The 2021 Constitution also restored a separate Constitutional Court, which had been folded into the Supreme Court as a Constitutional Chamber in 2010. Distinctively, statute recognises aksakal (elders') courts, elected local bodies that resolve minor property, family and neighbour disputes by customary norms with a right of appeal to the ordinary courts.
Legal tradition
Kyrgyzstan belongs to the civil law tradition.
How power is divided
Unitary. Seven regions (oblasts) plus the cities of Bishkek and Osh, subdivided into districts and local self-governing communities (ayil aymaks). Regional and district heads are appointed within the executive chain, while ayil kenesh councils are elected and hold defined local competences including local land allocation, which matters because pasture is managed communally under the Law on Pastures 2009.
Where law comes from
- The Constitution
- The 2021 text; supreme and directly applicable.
- Laws of the Jogorku Kenesh
- The Civil Code 1996-98, Criminal Code and Labour Code are the principal instruments.
- Presidential decrees
- A major source of operative regulation under the 2021 constitutional model.
- International treaties
- Ratified treaties are part of the legal system and prevail over inconsistent domestic law.
- Custom applied by aksakal courts
- Statutorily recognised for defined minor disputes, subject to appeal to the ordinary courts.
The legal profession
Advocates practise under the Law on the Advocacy and Advocates' Activity 2014, which created the Bar Association of the Kyrgyz Republic with mandatory membership and a single licence issued after examination and internship. Only advocates may conduct criminal defence. Notaries are separately licensed and their acts are compulsory for real-estate transfers, mortgages and many family instruments. Legal aid in criminal cases is administered by the Ministry of Justice under the Law on State Guaranteed Legal Aid.
