Government and administration in Myanmar
How the executive, legislature and administrative state are organised, and which body is responsible for what.
The three branches
- De facto executive — State Administration Council
- Formed 2 February 2021; exercises executive and legislative power by decree.
- Military — Commander-in-Chief of Defence Services
- Constitutionally autonomous; appoints the reserved legislative bloc.
- Legislative (suspended) — Pyidaungsu Hluttaw: Pyithu and Amyotha Hluttaw
- Bicameral with 25 per cent reserved military seats; not sitting.
- Judicial — Supreme Court of the Union
- Chief Justice appointed with legislative confirmation under the 2008 text.
- Prosecution — Union Attorney General's Office
- Prosecutes and advises government.
How legislation is made
Under the 2008 Constitution, bills passed both chambers and went to the President, with disagreements resolved in joint sitting. Since February 2021 legislation is made by the State Administration Council as law or order, published in the Gazette without legislative passage, and a series of such instruments has amended the Penal Code, the electronic communications law and the criminal procedure code.
