The legal system of Saint Kitts and Nevis

The smallest federation in the world, and the only Caribbean state whose constitution contains an express right of secession. Nevis has its own Island Assembly, Premier and administration, and under section 113 may leave the federation on a two-thirds referendum vote — a power invoked in the 1998 referendum, which fell short. Otherwise the system is standard Commonwealth Caribbean: English common law, the shared Eastern Caribbean Supreme Court, and final appeal to the Privy Council.

Legal tradition

Saint Kitts and Nevis belongs to the common law tradition.

How power is divided

Federal but asymmetric: Nevis has its own Assembly and executive with powers over island matters listed in Schedule 5, while Saint Kitts has no equivalent island legislature and is governed directly by the federal Parliament.
