Transitional Constitution of the Republic of South Sudan

Promulgated at independence in July 2011 as a transitional instrument pending a permanent constitution, and amended repeatedly — most significantly to incorporate the 2018 Revitalised Agreement on the Resolution of the Conflict in South Sudan, which restructured the presidency around a President and multiple Vice-Presidents and extended the transitional period. The permanent constitution-making process has not concluded and elections have been postponed several times. The text guarantees a bill of rights, recognises customary law, and establishes a decentralised state.

Separation of powers

Decentralised in form, with states and administrative areas whose number has changed repeatedly — from ten at independence to twenty-eight, then thirty-two, and back to ten plus administrative areas under the 2018 agreement. Local government includes county and payam tiers and statutory customary authorities.
