The legal system of Azerbaijan
A civil-law system with a Civil Code of 1999 drafted with German technical assistance and closely following the German structure, together with a Criminal Code of 1999 and a Code of Civil Procedure of 1999. The hydrocarbon sector operates partly through production sharing agreements ratified as statutes, which in case of conflict prevail over general legislation — a feature that matters commercially far more than its brevity suggests. Azerbaijan is a party to the European Convention on Human Rights. Soviet legal structures were replaced after 1991 by civil, criminal and procedural codes drafted on continental European models, but the prokuratura survives as a powerful supervisory prosecution service with functions that go well beyond charging decisions, and notarial formality remains heavy for property and corporate acts.
Legal tradition

How power is divided
Unitary, containing the Nakhchivan Autonomous Republic, an exclave with its own constitution, Supreme Assembly and cabinet whose acts are subject to review for conformity with the national Constitution. Rayons are administered by centrally appointed executive heads alongside elected municipalities with narrow competences.
Where law comes from
- The Constitution
- Adopted and amended by referendum; supreme, with international treaty precedence over statutes.
- Laws of the Milli Majlis
- Primary legislation; some matters reserved to referendum.
- Presidential decrees and orders
- Extensive normative role in implementing and supplementing statutes.
- The Civil Code 1999
- German-influenced codification of private law.
- Production sharing agreements
- Ratified as laws; prevail over conflicting general legislation in their scope.
The legal profession
Advocates belong to the Collegium of Advocates and, since a 2017 amendment, only Collegium members may represent parties in court — a change that sharply reduced the pool of practitioners able to litigate and prompted concern from the Council of Europe. Admission is by examination and interview. Notaries operate under the Ministry of Justice with a monopoly over authentication of property and family instruments, and legal aid in criminal cases is organised through the Collegium.
Law by topic in Azerbaijan
- Civil ProcedureDistrict courts, appellate courts and a Supreme Court on points of lawCivil proceedings begin in district courts, appeals go to regional courts of appeal, and the Supreme Court exercises cassation review confined to questions of law. Commercial disputes are heard by specialised administrative-economic courts.
- Criminal LawThe 2000 Criminal Code with life imprisonment as the maximum penaltyThe Criminal Code entered into force in September 2000, replacing the Soviet-era code. The death penalty was abolished in 1998, making Azerbaijan the first state in the region to do so, and life imprisonment is now the most severe sanction.
- Family LawThe Family Code of 1999 and mandatory civil registrationThe Family Code governs marriage, divorce and parental responsibility. Only marriage registered with the state registry has legal effect; a religious ceremony conducted without prior civil registration carries no legal consequence and is an administrative offence for the officiant.
- Employment & LabourThe 1999 Labour Code with electronic contract registrationThe Labour Code of 1999 governs employment relationships. Since 2014 all employment contracts must be registered in the state electronic information system before work begins, which has become the central compliance obligation for employers.
- Business & CorporateLLCs and joint-stock companies with ASAN single-window registrationThe Civil Code contains the corporate law provisions. The limited liability company is the dominant form, and registration is handled through the Ministry of Taxes and the ASAN service centres, often within a single working day.
- Constitutional LawA strong presidential republic under the 1995 ConstitutionThe Constitution adopted by referendum in November 1995 establishes a presidential system with extensive executive authority. Amendments in 2002, 2009 and 2016 lengthened the presidential term to seven years, removed term limits and created the office of First Vice-President.
- Property & LandRegistered title through the State Register of Immovable PropertyThe Civil Code governs ownership and the Law on the State Register of Immovable Property establishes registration as the basis of title. Foreign nationals cannot own land, though they may own buildings and hold long leases.
- Tax LawThe Tax Code with flat corporate tax and hydrocarbon-specific regimesThe Tax Code of 2000 sets corporate profit tax at 20 percent, VAT at 18 percent, and progressive personal income tax. Oil and gas contractors operate under production sharing agreements with their own tax terms that override the general Code.
- Immigration & NationalityThe Migration Code of 2013 with e-visa accessThe Migration Code consolidated Azerbaijani immigration law into a single instrument. Entry generally requires a visa, with the ASAN Visa e-visa system providing rapid electronic issuance for short visits, and temporary and permanent residence permits available on defined grounds.
