Legislation and primary sources

Where to find the authoritative text of the law in Madagascar, and how to confirm it is still in force.

Sources of law, ranked

Constitution
Supreme law; reviewed by the Haute Cour Constitutionnelle.
Codes and statutes
French-model civil, commercial, criminal and procedural codes.
Regulations
Decrees and orders issued under statutory authority.
Customary practice
Socially dominant in land and family matters and partially recognised.
International treaties
Ratified treaties rank above ordinary statute.

The legislative process

Bills originate with the government or members of either chamber, are examined in committee, and must pass both the National Assembly and the Senate; the Assembly prevails on disagreement. The Haute Cour Constitutionnelle may review a law before promulgation, and organic laws must be referred to it as a matter of course.
