Where to find the authoritative text of the law in Mongolia, and how to confirm it is still in force.
Sources of law, ranked
- The Constitution
- Supreme; any law inconsistent with it is void.
- Laws of the State Great Khural
- The Civil Code 2002 and Criminal Code 2015 are the principal codes.
- International treaties
- Become part of domestic law on ratification; the Constitution requires consistency with them.
- Government resolutions and ministerial orders
- Subordinate legislation, reviewable by administrative courts.
- Custom
- Applied only where a statute expressly refers to it.
The legislative process
Bills are introduced by members of the State Great Khural, the President or the Cabinet, considered in standing committee and then in plenary. The President may veto a bill in whole or in part, and the veto is overridden by a two-thirds majority. Laws take effect ten days after publication in the State Information Bulletin unless the statute provides otherwise. The Law on Legislation requires regulatory impact assessment and public consultation for draft laws.
