Sources of law, ranked
- The Constitution
- Supreme; as amended by referendum in 1999, 2003 and 2016.
- Laws of the Majlisi Oli
- The Civil Code, Criminal Code, Family Code and Labour Code are the principal instruments.
- Presidential decrees and government resolutions
- Extensive operative regulation, subordinate to statute.
- International treaties
- Recognised by the Constitution as part of the legal system, prevailing over inconsistent domestic law.
- Acts of Gorno-Badakhshan
- Apply within the autonomous region and are reviewable by the Constitutional Court.
The legislative process
Bills are introduced in the Assembly of Representatives by deputies, the President, the Government or the Assembly of Gorno-Badakhshan. After adoption they go to the National Assembly for approval; disagreement is resolved by a conciliation commission or by a two-thirds vote of the lower chamber. The President signs and promulgates, and may return a law for reconsideration. Constitutional amendments require a referendum, which is how each of the three amendment packages was adopted.
